Cybernomics

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", the "User") and Manziuk Artem, an individual entrepreneur registered in Ukraine, trading as Cybernomics ("Cybernomics", "we", "us", "our").
These Terms govern your access to and use of the website located at https://cybernomics.biz and the online game and related services made available through it (together, the "Service").
By creating an account, accessing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Cybernomics is a real-time, multiplayer, browser-based economic strategy game. The Service allows registered users to build and manage virtual companies and assets, trade, and compete with other players within a simulated economy.
The Service is provided on an ongoing basis. We may add, change, suspend, or remove features, game mechanics, content, or virtual items at any time in order to develop, maintain, or improve the Service, as further described in Section 13.
To use the Service, you must be at least 13 years old, or the minimum age required in your country to consent to the processing of your personal data, whichever is higher.
To make any purchase, you must be at least 18 years old, or the age of legal majority in your country of residence, and you must have the legal capacity to enter into a binding contract. If you are under 18 (or the applicable age of majority), you may not make any purchase, and you may use the Service only with the involvement and consent of a parent or legal guardian.
By using the Service, you represent and warrant that you meet these requirements and that all information you provide to us is accurate and current.
To access certain features you must create an account. You agree to:
You may choose a player name and a company name within the game. You must not choose names that are offensive, infringe the rights of others, impersonate another person or entity, or are otherwise unlawful. We may change or remove any name that breaches these Terms.
We may suspend or terminate your account in accordance with Section 12.
The Service may offer paid products, including but not limited to premium access, subscriptions, and virtual in-game items (each, a "Purchase"). The price, currency, and key features of each Purchase are shown at the point of sale before you complete payment. By completing a Purchase, you agree to pay the stated price together with any applicable taxes.
How your payment is processed depends on where you make the Purchase.
(a) Purchases made through our website. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. This means that when you make a Purchase through our website, your contract for the sale of that product is concluded with Paddle as the seller of record, and Paddle is responsible for processing your payment, charging applicable taxes, issuing invoices, and handling refunds. Your use of Paddle's checkout is also subject to Paddle's own buyer terms and policies, available at https://www.paddle.com/legal/checkout-buyer-terms.
(b) Purchases made in our Android app from Google Play. If you install our app from Google Play and make a Purchase within that app, your payment is processed through Google Play's billing system. Such Purchases are sold and handled by Google, and your transaction is also subject to the Google Play Terms of Service and Google Payments terms. You can view and manage these Purchases through your Google Play account.
If you have purchased a subscription, it will renew automatically for successive periods at the then-current price until you cancel it, unless stated otherwise at the point of sale. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then. Subscriptions purchased in our Android app must be managed and cancelled through your Google Play account.
We want you to be satisfied with your Purchase. How a refund is handled depends on where you made the Purchase.
The following terms apply to our refunds:
Any virtual currency, virtual goods, companies, assets, or other in-game items (together, "Virtual Items") are part of the Service. Virtual Items have no monetary value, are not real currency or property, and cannot be redeemed for cash or exchanged for anything of value outside the Service.
When you obtain a Virtual Item, we grant you a limited, personal, non-transferable, non-sublicensable, revocable licence to use that Virtual Item within the Service only. You do not own the Virtual Item. We may modify, manage, regulate, or remove Virtual Items at any time, including as part of balancing or updating the game.
You must not buy, sell, trade, or transfer Virtual Items or accounts for real money or other consideration outside the Service.

We may take any action we consider appropriate in response to a breach, including removing content, restricting features, or suspending or terminating your account.
The Service, including its software, source code, design, graphics, text, game mechanics, and all related content (excluding content you submit), is owned by or licensed to Cybernomics and is protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use. All rights not expressly granted to you are reserved.
You may not copy, modify, distribute, sell, or lease any part of the Service, except as expressly permitted by these Terms or by applicable law.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, regarding the Service, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. Nothing in this Section affects any statutory rights you have as a consumer that cannot be excluded under applicable law.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid to us (through Paddle) in the twelve (12) months immediately preceding the event giving rise to the liability, or (b) ten US dollars (USD 10).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
You may stop using the Service and close your account at any time.
We may suspend or terminate your access to the Service or your account, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms, that your use poses a risk to the Service or other users, or where required to comply with applicable law.
On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, 14, and 15) will continue to apply.
We may modify, update, suspend, or discontinue all or any part of the Service at any time, including game features and Virtual Items, in order to develop and maintain the Service.
We may also update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice through the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-law rules. This does not deprive you of the protection of any mandatory consumer-protection provisions of the law of your country of residence.
Please note that your separate purchase contract with Paddle (as Merchant of Record) is governed by Paddle's own terms and the law specified therein.
